U.S. Supreme Court justices on Monday wrestled with the potentially broad consequences of a rape case that could lead to huge swathes of Oklahoma being deemed tribal territory, with Justice Neil Gorsuch emerging as a potential decisive vote.

If the justices side with McGirt, that effectively would recognize for the first time much of eastern Oklahoma, including the entire city of Tulsa, as reservation land. Gorsuch questioned Oklahoma’s reliance on later historical evidence, including that the tribe had previously appeared to accept that its land was not a reservation.

McGirt is a member of the Seminole Nation but the crime occurred on land historically claimed by the Creek Nation. Some justices including conservative Justice Samuel Alito appeared concerned about the potentially broad ramifications of a ruling backing tribal authority.“This is easily fixable by Congress,” Sotomayor said.

This will be interesting to watch, the court has done a great many stupid things but it's hard to imagine them telling the tribes not to protect themselves from the virus. Then again it is a Republican supreme court so anything is possible.

the OK republican legislature has cut richie-rich's taxes multiple times. now that the bill is coming due, via bigly holes in the state budget, the governor wants to shake-down the *real* natives.

Considering we stole the entire country from the Native Americans, reneged on our treaties over and over again, lied, murdered, raped, and committed mass genocide in the name of money (how very Christian of us), I'd say we ought to err on the side of the tribe.
