The appeals court ruling stems from a lawsuit involving Evelyn Sineneng-Smith, a former California immigration consultant. Sineneng-Smith was sentenced in 2015 to 18 months in prison after a jury convicted her on tax and mail fraud charges. She also was found to have violated the law about encouraging foreigners to reside illegally in the U.S.
