The Supreme Court will take up a dispute over a federal law that makes it a crime to encourage foreigners to enter or reside in the United States illegally

The federal law at the center of the latest challenge predates the Trump administration, but could be used to intensify Trump’s enforcement push if found constitutional. The appeals court ruling stems from a lawsuit involving Evelyn Sineneng-Smith, a former California immigration consultant. Sineneng-Smith was sentenced in 2015 to 18 months in prison after a jury convicted her on tax and mail fraud charges. She also was found to have violated the law about encouraging foreigners to reside illegally in the U.S.
