The Supreme Court dodges a case involving a baker's refusal to serve gay customers on religious grounds, sending it back to the lower courts

The court's decision puts off a major case for next term and allows the issue to further percolate in the courts below. The court took over three months, discussing the case behind closed doors, to render Monday's summary decision. The timing suggests the justices were debating different ways of resolving the case, short of putting it on the calendar for next term.It was a summary order of two sentences with no noted dissents.

Read More"By asking the state courts to reconsider their ruling in light of Masterpiece Cakeshop, the Justices are, in effect, asking the Oregon courts if a similarly narrow basis is available for resolving this case -- even though the parties have framed the case as presenting a broader conflict between the constitutional rights to religious liberty and same-sex marriage.

you need to fix this tweet

Gee, it would be nice if you folks would make SOME attempt at getting the facts straight before writing such misleading headlines & stories.

Is 'misleading' news like 'fake' news? Asking for a friend.

Nice fake headline.

This is a lie. The bakery refused to make a wedding cake.

'refusal to serve gay customers' Wrong...you know it, but you have a narrative to push.

Delete this, as it's more than misleading. And let's be honest, this was worded in this manner intentionally.

No, they didn't refuse to 'serve' a customer? This is a lie ,,,, as usual. Seriously can you awful leftist try just once, once, to actually report something factually. FakeNews

Doing some selective editing there FakeNewsCNN on the clickbait headline

Keep it up. 2020 will be just like 2016. You people are so dense that you can’t see this is why Trump won last time.

False tweet. They serve gay customers all the time. They refused to bake a cake for a gay wedding. Legally, very different cases

Grow a set. Hiding behind religion so you can discriminate is BULLSHIT

businesses have the RIGHT to refuse to serve ANYONE for ANY REASON. if the gays dont like it, why not just go to another bakery instead of being assholes and trying to ruin someone's life because it hurt your feelings they dont like gays. liberals are petty as hell

Hey banana News, fix your title. They weren't refused service, the baker refused to make a special cake.

Lower court judges generally do not understand the laws, this is why many rulings must be appealed to higher courts. This should not be necessary to waste innocent peoples time , money,+ruin small businesses, but citys do this deliberately to force issues or run businesses out.

They didn’t refuse to serve gay customers. They refused very specifically to make a gay wedding cake, which scores of Portland bakeries would happily do. I think you know this and deliberately misstate the facts. In short, yo7 lieto further the Regressive narrative. It’s all u do

COWARDS

Freedom is not the right to do what you want but not to do what you do not want to!

Victory !!!!

This is all stupid. No artist, whether their medium is paint or frosting, should be forced to produce their art under any circumstances. Next you'll be demanding cakes for pedophile weddings when you finally shove those down our throats.

FakeNews actually it's Defamation as they serve any and all gay customers, they don't do gay themed creations that stomps on their First Amendment speech and religion icymi

They never said they would not serve gay customers. That's not what the case is about. Go back and do some research, CNN.

So much for “all we want is tolerance”...

They never refused to serve gay customers - just refused to make a gay wedding ceremony cake. Probably would refuse straight xtians wanting them to make a Halloween cake too.

Why are you purposely misleading readers with this tweet? Can you guys not get one damn thing correct these days?

Dishonest hacks.

They didn't refuse to serve gay customers. CNN lies again to push a false narrative.

There is not one single person employed by ATT’s CNN intelligent enough to understand this issue. It involves creating a same-sex wedding cake, not serving gay customers. CNN must be pretty close to 100% Fake News.

Original tweet is a LIE. They didnt 'refuse to sell to gay customers.' They said the couple could buy any cake already made. They said they wouldnt create a cake for their wedding thereby participating in the occasion on religious grounds.

Why does CNN always try to mislead? Why can't you ever be honest? Just report accurately. Is that so hard? This is why your ratings are in the toilet.

That is dishonest tweet.

Go down the street and buy your damn cake....

And you don't like the term 'fake news'. Then stop pushing it!!

False reporting...again.

This tweet is a LIE..More fake news..The case is specifically about the refusal to provide services for a same-sex wedding. They would not decline to serve a gay couple otherwise.

Why are you lying and claiming that the case is about refusing to serve gay customers? If you don't think that truth is good enoughnfor a click what does that say about you? The people running cnn's social media are the bottom of the barrel

Your headline is journalistic malpractice. Do better.

Gigantically misleading headline. Typical CNN.

Except they didn't refuse to serve gays and do serve them regularly. Your headline is intentionally divisive and misleading.

Twist, Spin and lie! This is CNN

So if someones ex son in law who beat his daughter black and blue went in and asked the ex father in law for a cake saying hitting the punch bag (he a boxer) and the father in law refuses he will get sued. Ok got it.

Hang on. My local supermarket has a sign that says they have the right to refuse service to anyone without providing a reason. Like my phone company and Internet service. But this baker doesn't have the right? PC culture at its finest.

For people that is against the baker. I have 2 illustrations. 1 go to a Baker that hate trump and ask for customised cake of trump shower on Obama. 2 go to a Muslim Baker to ask for a cake of birth of christ. I would not do either cause I do not want to hurt their feelings.

Freedom is not absolute. The bakery owner has freedom, too.

Ashers going global 🤦🏻‍♂️

That’s false.

Freedom of association is an intrinsic right. You cannot force me to serve anyone and I don’t have to have a reason

'The justices sent back the case pitting religious liberty concerns against LGBTQ rights to the lower courts for further consideration in light of last term's ruling in favor of a Colorado baker who refused to make a cake for a same-sex couple.'

The justices' move wipes away a ruling that went against a bakery in Oregon that refused to make a cake to celebrate the wedding for a same-sex couple

Its America he has that right! Stop pushing your agenda on a people that don't want or care about it. Less than 4.5 percent of population but we have to here this crap daily. Cnn/fakenews there are real problems in this country this isn't one! Trump 2020 KAG!

'Dodge'? The Court recognized that this sort of malarkey should have been resolved at the lower court. Defense of freedom is what matters here. Not defense of hate, vileness and faux outrage.

What if stores refused to serve Trump supporters?

I think the simple, general, answer is that the baker is obligated to consider any request for a commission but is not obligated to accept the commission. She can refuse to bake a cake for any reason, or for no reason at all.

Anyone who chooses to open a bakery and simply sell the cakes they’ve made cannot refuse to sell a cake to someone (short of a ‘no shirt, no service’ restriction). If a baker decides to accept commissions the issue then is if and when she can refuse to bake a cake.

No-one, I think it’s clear, is obliged to open a bakery. It’s a free choice. Further, no-one who chooses to open a bakery is under any obligation to accept commissions - they could simply bake whatever cakes they like and put them on the shelf for sale.

I don't understand why they didn't write a bad review on Yelp. It seems that businesses are more concerned about that than anything else these days.

Weak. Can't wait for this to blow back harder. This kind of argument will be heard at some time but perhaps not with this circumstance. When a store denies a particular religious person's cake or denies a persons name for being different, we will see this in the courts again.

All they had to do was just put a sign up. Hope business going great after that. Not.

Stop wasting courts time. Solution is easy.. like most people .. just go down the street and give someone else the ur business.

This is a bullshit lawsuit, that is why it's taking so long.If you open your business to the public, that is what it is,TO THE PUBLIC.These Oregonians had their shop in a strip center, next to a vape shop, and a tattoo place,so what's their problem?

Describes the action taken perfectly... 'Dodges'...

Justru agama melindunginya.

To be fair...it’s not illegal to be a dick...

Supreme court doesn’t want to look like bigots.

All politics aside what poor customer service like money is money and imagine all the lost customers you will lose now like what

The Supreme Court asks the Appeals Court to consider the case in light of a top Court holding it from last year.

cowards

Supreme Court says lower court should reexamine case over same - sex couple denied wedding cake.

Mis-direction again by CNN They “dodged” it because they want to try these cases on other grounds to correct some bad rulings in the past and eliminate the lemon test.

I’ll even dismiss the case on religious ground

Good. It's his place he can do what he wants.

Business owners need to learn these magic words: “Oh, I’m so sorry, looks like we’re booked solid that weekend. Here, let me recommend some other businesses that may be able to help.”

'Dodges:, eh? Is this supposed to be reporting, or editorializing?

Sorry but I wouldn't want anyone that doesn't like me making my food.

The freedom to go to another bakery is under threat

zipped

Stories like these make no sense. That’s how you make money. Put your beliefs (no matter how antiquated they are) to the side. People are people. All that matter’s is how good the couple are.

If they know ruling against the same sex couple will spark backlash and obviously hurt Trump then refusing to do so is COWARDICE.

Supreme Court sends gay wedding cake dispute back to state courtsThe Oregon case raises the same issues as the Colorado baker a year ago who refused to provide a custom cake for the wedding of two men. These cases are always weird to me. Like I get the discrimination is wrong but on the other hand, I don't want you making ANYTHING for me if you're a hateful bigot. I can’t believe in this day and age, there are no gay owned bakeries. It'll be interesting to see how this plays out. With the court becoming more conservative (and without knowing how long RBG will remain on it) time seems to be the most influential factor. Not to mention their is a similar case rising through the courts pertaining to a florist.

Supreme Court declines to change double jeopardy rule in a case with Manafort implicationsTrump's former campaign manager might have been helped if the case involving an Alabama man on gun and robbery charges had been overturned. Then the state could charge him and basically have his confession as additional evidence. 🔥👏🏽 Watch out Trump. NY and NJ may be coming for you.
