Two issues here. One is, as a driver, in most states you have implied consent. That means in exchange for driving and getting a license you agree to consent. Secondly, get a warrant. How hard is it to avoid the problem?

Doing anything to an unconscious person is akin to rape, warrant or not.

I agree, this person did not or could not give consent... More importantly, I think people should be able to use ignorance of the law as an excuse...
