The Biden admin has asked the Supreme Court to take emergency action to stop lower courts from sharply restricting access to mifepristone, a drug commonly used for abortions.

by the New Orleans-based 5th Circuit Court of Appeals. The Texas-based judge, Matthew Kacsmaryk, said the FDA’s 23-year-old approval of mifepristone — as well as the agency’s more recent policies to expand access to the drug — should be suspended. A three-judge panel of the 5th Circuit blocked the portion of Kacsmaryk’s ruling that suspended the original approval, but the panel agreed with him that the policies expanding access should be paused.

Without action by the high court, the 5th Circuit’s decision is scheduled to take effect on Saturday and access to mifepristone — which is used in more than half of abortions nationwide — could be immediately curtailed. Danco argued in its appeal that while the 5th Circuit’s ruling technically leaves the original FDA approval of mifepristone in place, it could function as a temporary ban on the drug in practice.

The drugmaker also said it faces a potential catch-22: It needs approval for new labels and other materials in order to comply with the 5th Circuit’s directive, but the FDA may be unable to give that approval due to a separate order from a judge in Washington state barring the FDA from taking any action to restrict access to the drug in many states.Both Danco and the Justice Department emphasized
