KOTA KINABALU: The Federal Court has ruled that Datuk Seri Musa Aman's son, Yamani Hafez Musa, can keep the Sipitang parliamentary seat.

Chief Justice Datuk Tengku Maimun Tuan Mat dismissed an appeal against the decision of an election petition brought by Noor Hayaty Mustapha from Parti Warisan Sabah.

Justice Tengku Maimun - who led a five-member panel during the hearing - said the court was not persuaded by the appeal which argued that the Election Court erred when making its decision. In the decision on Wednesday , the Federal Court dismissed the appeal with costs of RM 40,000 to be paid to Yamani Hafez and RM30,000 to the second and third respondents, returning officer Matlin Dullah and the Election Commission.

Previously on April 8, Election Court judge Azahari Kamal Ramli had struck out the case on the seat held by Yamani Hafez. On Oct 15 last year, the Election Court here had earlier struck out the petition but the Federal Court then ordered the election petition to be returned the Election Court for trial, putting the case back on track.Tags / Keywords:
