Warnings new drink driving laws will 'decrease deterrence and increase offence' | LucyCormack

The NSW Law Society has criticised new penalties designed to crack down on drink driving, saying they will only "decrease deterrence and increase offence and recidivism rates".

"We are particularly concerned that the effect of the 'drink driving is a crime' campaign will be diluted if low-range drink drivijng offences are dealt with by penalty notices rather than by the courts," she said."There is a genuine deterrent factor for first-time low-range offenders in going to court.

She argued that rather than easing pressure on the local court, the new laws could have the opposite effect. "We are of the view that the reforms will decrease deterrence, increase offence and recidivism rates, and have a significant impact on people's livelihoods, particularly those living in regional and remote areas that lack public transport options and where courts sit on a part-time basis.

LucyCormack The story has two sides - perhaps a line or two from the legislators would be handy. Don't agree with any watering down of PCA laws - too dangerous IMO, but to lead with comments from lawyers who are losing some of their livelihood is poor reporting. Smacks of self interest.

LucyCormack Penalties are predominantly revenue rather than safety based. Its Police rather than community derived laws hence control based

LucyCormack That’s entirely the point. Guilty until proven innocent. Somewhat at odds with the law of the land imo.
