An ACT Supreme Court jury finds Canberra man Justin Benn guilty of one count of rape and one count of assault against his former wife in 2017, but is unable to reach a verdict on a second rape charge and three acts of indecency.

Public servant Justin Benn is behind bars after being found guilty of one count of rape and one of assault against his former wife.

But the jury was only able to reach verdicts on two of the charges, with another charge of rape, and three charges of acts of indecency still outstanding.The two offences Benn was found guilty of happened in 2017, well before the relationship ended in 2021.But prosecutors relied on tendency evidence about other events involving violence, even pointing to the number of repairs on the walls inside the couple's home, telling the jury Benn was a person prone to fits of rage.

The rape charge related to an incident when the woman woke to find Mr Benn conducting sex acts on her while she was asleep.
