A Melbourne engineer who claims a colleague repeatedly farted near him and "thrusted his bum" at him has vowed to go to the High Court after losing his bullying case on appeal.

The Court of Appeal ruled against Mr Hingst on Friday, refusing to grant him leave to appeal and ordering him to pay the defendant's legal costs.In response, Mr Hingst promised to take the case to the nation's top court.Mr Hingst did not speak to reporters as he left court on Friday, with an item of clothing held over his mouth and face.

"He would fart behind me and walk away. He would do this five or six times a day," he said outside court. He claimed he didn't get a fair trial as he felt under pressure from Supreme Court Justice Rita Zammit when questioning witnesses, and felt the judge was biased against him.
