Brian Benjamin was picked by Governor Kathy Hochul when she ascended to the Office of the Governor after Andrew Cuomo's resignation. His tenure was short-lived, lasting just seven months from September 2021 to April 2022.accusing him in a scheme to exchange a state-funded grant for campaign contributions while a State Senator in 2019. Benjamin was arrested on April 12, 2022, and resigned by the end of the day.
In a ruling out Friday, a panel of appellate judges now argues the initial indictment did in fact sufficiently allege an explicit quid pro quo. The case now moves forward but under a veil of uncertainty.The alleged bribery scheme involved plans to funnel $50,000 in state funds to a developer named Gerald Migdol. According to, Migdol would likely have been a key witness for prosecutors, but he died in February.
According to prosecutors, Benjamin said in a vetting questionnaire that he never used his power as a government figure to aid a donor; just hours after submitting the form, Benjamin allegedly called Migdol for the first time in months.If convicted, Benjamin faces at least five years in prison for the conspiracy charges and up to 20 for wire fraud and each count of falsifying records.
