Construction continues on a section of refurbished boardwalk recently reopened in Wildwood, N.J. on Thursday, April 6, 2023. The section, from Maple Avenue to 26th Avenue, is phase two of a multi-year project that includes new concrete pillars, decking, handrails, access ramps and lighting.will continue this week after a judge denied a contractor’s objection to the winning bid from Fred M. Schiavone Inc.
“We are happy with the court’s judgement because we knew that this administration conducted a fair bidding process and had faith in the contractor, Schiavone Construction,” acting Wildwood Mayor Krista Fitzsimons said in press release Thursday afternoon. The bid included the base bid for work listed in phase 3 as well as all three additional alternative bids. L. Fierozzi’s bid was approximately $300,000 higher than Schiavone’s.
L. Fierrozi’s attorneys argued that the steelwork included in the scope of the project was not just ornamental but structural and required the expertise of an experienced ironworker. Oral arguments were heard in Superior Court in Cape May County on Wednesday. In his decision issued later that evening, Judge Michael Blee denied any further injunction and sided with the defense.
Judge Blee disagreed with the L. Fieriozzi’s argument that this amounted to a subcontractor rather than a manufacturer.
