Court: Online free speech rights trump stalking conviction

A North Carolina man imprisoned for stalking had his conviction overturned Tuesday when a state appeals court ruled the social media posts that prompted the charges were protected by free speech rights.

Shackelford will remain in prison for now because of the lag between when an appeals ruling is filed and when its mandate, or final effect, is issued. Sensing "red flags," the woman told Shackelford she couldn't meet with him, but he later sent five- and seven-page handwritten letters to her home and work addresses asking to take her on a date, according to court documents.

According to the ruling, that same day he posted a Google Plus message saying: "The pain hurts because I dreamt about this woman and believed that she was my soul mate. How could God be so wrong???"

Once again the court system shows how it is one of the main causes of the problems in this country.

There's a criminal element if his behavior provokes others to do the same.
