A judge has ruled the 14-year-old, who kicked Declan Cutler but did not inflict fatal injuries, is not guilty of murder.

A Supreme Court judge has cleared a 14-year-old boy of murder, despite his involvement in a frenzied gang attack that claimed the life of a teenager. Declan had just left a party when he was stabbed dozens of times and left to die on the footpath by a youth gang, who were feuding with a rival group in the area.The Supreme Court heard PM's role in the killing was less violent than the other co-offenders, who were older teenagers under the age of 18.Prosecutors still pursued PM for murder, alleging he entered into an agreement with other gang members to cause death or serious injury.

The key dispute in the case centred around the legal principle of Doli Incapax, which applies to alleged child offenders aged between 10 and 14 in Victoria.
