A new Ontario law that allows hospitals to fine discharged patients $400 a day if they do not move into a nursing home not of their choosing violates the Charter of Rights and Freedoms, advocates allege in a lawsuit filed Wednesday.

The Ontario Health Coalition and the Advocacy Centre for the Elderly say a law that allows hospitals to charge discharged patients $400 a day if they do not move to a nursing home that's not of their choosing violates patients' rights to privacy and informed consent.

This must be a bad joke. The CONS love shouting freedom and government encroachment and then engaging blatant violation Who is fooling who?

2) it also takes resources and time of paper work to release and admit.alot of work goes into new admittance.LTC has really turned to short term care.either we need more LTC facilities or even a STC facility.all would require more nurses psws etc..

1)Alot of elderly ready to die are being shipped to LTC and its becoming a problem because they are full and can't take as many LTC people.tge hospital just needs to keep most to make spots available for not the immediate dying.this has been happening since covid of course

But the CBC is good with freezing bank account and lying about money coming from foreign actors donated to the freedom convoy.

HINT: “The patients do not have the right to review or appeal decisions”. The MoH reported a 18% reduction in the ALC to long-term care wait list. What percentage were moved to LTCs not of their choosing? How many have stayed in hospitals and paid $400/day?

Wow Ontario is sure just trying to ram all these dictatorship like Bill's through

Pitiful

Gee….ya think?

Well, one assumed that this would happen, but of course, now we get to pick up another of Dougie's legal bills.................

Well what do people expect. It is not a hotel. Beds are needed. Unfortunately there are not enough LTC beds in the GTA so there are limited options.

We should charge dr’s and nurses $4000 every time they can’t cure a problem

'fine discharged patients $400 a day if they do not move into a nursing home not of their choosing violates' Said seniors are in for a nasty shock if they ask for maid service to clean their homes.

Good! ThugFord must learn that he can't run roughshod over Ontarians' Constitutional rights. The absurd thing is, the public will pay for his corruption, over and over again.

The turds treatment of our seniors is criminal.

How are you still not labeled as state funded propaganda

Thats so wrong on so many levels. With the waiting periods to get into nursing home or retirement homes. How can the government think its ok. Its just another way the government shows everyone, they don't give a shit about anyone.

I see the charter being brought up an awful lot these days.... In case you missed the past 3 years, it means nothing.

Um yeah…. These poor people have paid taxes their entire fucking lives. You give them back the bare minimum and now you want to fine them because they don’t reside where YOU, the cheap fucking govt, want them to?! DISGUSTING

And fordnation will spend millions fighting yet another unconstitutional law. The government that can’t govern legally, what a joke of a premier…

prinzadelbart PierrePoilievre in the real world of Canadian politics, Conservative Party of Canada and the leader of the Official Opposition Pee Pee hurts Canadians.

I don’t feel bad for those boomers - they led us to this mess… and they expect us to clean it and take care of them…

Get ready for the notwithstanding clause to be invoked by ford when he loses…

Steven Schreibman has solid legal credentials, but I can’t see this suit as being successful, nor do I think it is a violation of anyone’s rights to be removed from hospital when doctors determine you no longer need to be there.

so now you care about Charter rights?!!!

Good!

Finally,an acknowledgement of the devastation this bill causes. Not only are seniors in hospital being treated like chattel to be moved around for convenience but the disastrous law discriminates against & treats those waiting to reconcile with their beloved spouse with neglect.

Too late. You let them lock you down for 2 years. Anything goes now.

So they can keep charging until you're bankrupt? Who's going to pay for the home then?

The hospitals they will work with you. I gave a reasonable radius and they completely understood. Bill 7 is a very hard bill to grasp but again if you work with the team at the hospital they will work with you.

There was one 2 hours away and I explained that my father wouldn’t be able to be visited because of my life and work and my other family members. The coordinator understood and is going back to her placement team. If you work with. 2)

So this bill I am in the midst of experiencing it. If you as a loved one or POA are really picky maybe that when this comes into effect. I was just asked because when In hospital you have to pick 2 short term homes. 1)

Damn those meddling kids! FordFailedOntario NeverVoteConservative

This is necessary. Old people are clogging up the hospitals for those who need them and nurses and doctors are frustrated. This law was very smart. Liberal courts destroy our systems

Selfish freeloaders!

I have no idea why the CBC hasn't been labeled as 'State Affiliated Media', like the BBC

Can you blame patients, esp. after the horrific stories of abuse and inhumane care in some of these LTCs?

A logical law that is too logical and therefore will be found in violation of the Charter by our left-leaning judicial system.

Don't agree with the fine, but also understand acute care beds are held hostage by people waiting long term care. Even longer wait if they refuse first available LTC bed. Need a convalescent or halfway home for discharged patients to wait for LTC beds, allow some choice.

I never understand why hospitals send people to random nursing home instead of their choosing .

There you go. Appointed judges, who you don't vote for, will create law in Ontario. The politicians, who you vote for, to enact laws, will be silenced. Democracy is dead in Canada.

Talk about money grab

NeverVoteConservative

And what about the rights of the person that needs the hospital bed?

CBC reports on personal freedoms and medical overreach. Strange days.

Do we have too many freedoms and too many lawyers ready to file pieces of papers. Most countries do not have the health care as Canada does. Yes there are problems but compared to reality ours is good.

If they have a bed move them and stop clogging up our hospitals

What is the rationale behind this? More government control of peoples’ lives? freedom

I thought they just pay the daily rate until they are appropriate place. Am I wrong? Very simple

That’s terrible !

This is a big reason why EDs always have a backlog. Patients need to be moved out of hospital beds and into permanent housing.

Advocate allege in lawsuit new Ontario nursing home law violates CharterAdvocates allege in a lawsuit that a controversial Ontario long-term care law violates the Charter of Rights and Freedoms. Advocacy groups should be put on notice that enough is enough. They are doing more harm. As for elderly people taking up beds in hospitals because they don't want to move TFB. If a young person dies because some old fart is taking up a bed is the real problem.
