NEW: Conservative Supreme Court justices seem skeptical of President Biden’s student debt relief plan, pointing to the economic impact of forgiving loans for 40 million borrowers.

The Biden administration says debt relief is permitted under a 2003 law called the Higher Education Relief Opportunities for Students Act, or HEROES Act. The law states that the government can provide relief to recipients of student loans when there is a “national emergency,” allowing the government to take action to ensure people are not in “a worse position financially” as a result of the emergency.

Of the six conservative justices, only Justice Amy Coney Barrett repeatedly probed whether challengers had legal standing. Chief Justice John Roberts and Justice Brett Kavanaugh, two justices the Biden administration may have been targeting as potential votes against standing, focused their questions on the major questions doctrine. That could indicate they believe the challengers have standing.

Kavanaugh cited the other recent cases in which the court has cited the major questions doctrine in ruling against the government and suggested the student loan plan followed a similar pattern.

Relief for student loans has got to be the stupidest idea ever brought to the table. It is the biggest insult to hard working loan paying Americans everywhere in our country. I got a student loan going through college the relief I got was low interest and ten years to pay it off.
