New court filings show prosecutors have dropped the possibility of a sentence enhancement against the actor in a fatal film-set shooting

Prosecutors have dropped the possibility of a sentence enhancement that could have carried a mandatory five-year sentence against actor Alec Baldwin in a fatal film-set shooting, according to new court filings made public Monday.SANTA FE, N.M. — Prosecutors have dropped the possibility of a sentence enhancement that could have carried a mandatory five-year sentence against Alec Baldwin in a fatal film-set shooting, according to new court filings made public Monday.

“The prosecutors committed a basic legal error by charging Mr. Baldwin under a version of the firearm-enhancement statute that did not exist on the date of the accident,” Baldwin’s attorneys said in an earlier court filing.

Rust Movie Productions said last week a related documentary will detail the film’s completion and Halyna Hutchins’s life.

Fire arms enhancement charges should be dropped in all cases.

‘Rust’ Prosecutors Drop Five-Year Gun Enhancement Against Alec BaldwinProsecutors have dropped a five-year gun enhancement against Alec Baldwin and Hannah Gutierrez-Reed, after the defendants argued that the law did not apply at the time of the shooting on the set &… This was a huge mistake by prosecutors, and a big win for Alec Baldwin. They overcharged him in a case that should’ve never been brought in the first place, and now they’re going to pay for it if this ever goes to trial. The PR hungry prosecutor messed up in a way a first year law student would have seen. Then instead of admitting their terrible error they continued to pretend they did not screw up while correcting their mistake. Not a good look. That's ridiculous. They act like he brought a gun, and deliberately put a bullet in to kill someone. Every actor in the U.S. should be concerned and speak out against it. It could have been anyone. The armorer is the one that should be in the hot seat solely, criminally.

Alec Baldwin and ‘Rust’ Armorer Charges Downgraded, Removing Potential Five-Year Prison SentenceThe decision follows lawyers for the actor and Hannah Gutierrez-Reed filing a motion arguing that the case's prosecutors incorrectly charged both under a New Mexico firearm law that had passed after the fatal shooting of Halyna Hutchins on the film's set. Why? I can see the logic in downgrading it for Alec Baldwin, given the assurances from the armorer, but why the armorer? They failed at their job. whew! bet all the stress taught him to check the gun next time tho..lol AltwiesMary AlecBaldwin CourtTV CourtTVUK alecbaldwin Who didn’t see this coming!
