Browne said the trial judge made a palpable and overriding error in relying on an online dictionary definition of a tuck seine when finding that Crocker “purposely and intentionally completed his logbook to cover up the illegal fishing” instead of allowing the parties to make further submissions on the distinction between a tuck seine and purse seine.

Background information provided in Browne’s decision states that the trial judge found that Young and Crocker entered into an arrangement that was a “serious scheme of illegal fishing.” Each later sold their catch to the local fish plant and Young and Crocker pooled the proceeds from their respective catches, which was then shared equally.
