The effect was to give judges discretion to “stack” 25-year ineligibility periods arbitrarily high for someone like Bissonnette, effectively denying them the possibility of parole. It is this “stacking” provision that has now been struck from the law as incompatible with human dignity.
Great! So as society changes — let’s imagine that there’s an unanticipated wave of mass murderers whose chief interest is running up the score as high as possible — the law will naturally adapt as public opinion evolves. This might even involve Parliament introducing the hypothetical possibility of life sentences without realistic possibility of parole. And if the conscience of the public is satisfied, the Constitution must accommodate this evolution.
Still, that part of the decision is right as far as it goes: there are some punishments that are absolutely proscribed, no matter how repulsive the offence. Can life without parole be squeezed into that category? The court had to reconcile its decision with its, which justified 25-year parole ineligibility periods even for elderly offenders for whom this would mean life without parole.
Only thing colbycosh is missing is the spirited defence of this ruling from the self-proclaimed 'party of the charter'. Any Liberal MPs want to articulate what they love about this ruling, why it's good, why this is the Canada they want so bad? R_Boissonnault ? DavidLametti ?
SCOC is totally wrong. cdnpoli
That’s dishonest of the Post, something you do well and weekly! None of these people will get a parole and will die in jail like Olsen! You’re feed the paranoia and should be ashamed1
Does anyone have a count on how many criminals this would apply to? Have there been multiple mass-murders convicted since 2011? 1? 2? 10? I can think of one that hasnt been sentenced yet. A sense of scale would give perspective.
Eligible for parole doesn’t mean he will get it! Example is Bernardo …
Why are earth do we care so much about criminals? Why is it always about them. How is it that the Defence Lawyers in Canada do such a good job at discounting & dismissing the victims? How does that even happen. colbycosh Unbelievable.
If you target a 'group of people' & they happen to be a certain gender, sexual orientation, a certain religious group etc. then that should be enough to warrant a Hate Crime Charge & extent the prison sentence based on that. The courts should require anything else.
It should be like Paul B . Should be a fender for life .For what did . No parole. Live sentence . Send a wrong message for mass murders
The only thing they should give is a choice of injection, hanging or the chair
The only way this guy should leave prison is in a hearse.
Ya, the Post got it wrong as well. It’s not about the sentence but the period of time a person can be imprisoned without the eligibility for parole.
And don’t believe this bs about them not grtting parole. They get parole! Even before 25 years day parole and other forms of release.
Excellent ruling. Those poor poor murderers finally getting justice! Also; when do we get a new constitution? One that doesn’t punish the law abiding and doesn’t hug the thugs? Will Justin correct the mistakes of his father?
Shows what a liberal based court will do to appease a wacky NDP/liberal union. System for liberal court appointed judges.
'Life' in prison is a term of 25 years. Death Penalty was removed (in practice) by the Federal Liberals in 1963, made law in 1976, by the same party. PMJT in his first ever annual budget bill, included lighting up of the sentences involving gun and gang crimes.
Even unanimous judgments can be f*cking stupid.
Pathetic, this just confirms that crime and punishment in Canada is not about the victims. A murder victim does not get a second chance therefore neither should the convicted killer. LIFE in jail should be life, until they die. Or capital punishment.Especially for mass murderers
