The Supreme Court of Canada has unanimously struck down a law that allowed judges to impose consecutive periods of parole ineligibility for people convicted of multiple murders — a decision that means the Toronto van attacker will have to wait no longer than 25 years to be eligible for parole.
“In light of this conclusion, the Chief Justice declared section 745.51 invalid from the time it was enacted in 2011. As a result, the law that existed before that date continues to apply,” according to the “case in brief” posted on the Supreme Court website. In March, Canada’s top court heard arguments about the constitutionality of that provision in the case of Alexandre Bissonnette, who pleaded guilty to murdering six people and attempting to kill six others at the Islamic Cultural Centre in Quebec City in 2017.
The Quebec Court of Appeal ruled in his favour, finding that the 2011 provision constituted cruel and unusual punishment, and reinstated the 25-year parole ineligibility period.The top court’s ruling will have an impact on other cases across the country, including the sentencing of Alek Minassian. He was convicted of murdering 10 people in the Yonge Street van attack in Toronto in 2018. His sentencing hearing is set for June.
