MONTREAL — Since the Supreme Court struck down the sections of the criminal code pertaining to abortion in 1988, the political history of the anti-abortion lobby in Canada is that of an unbroken losing streak.
Back in 1988, the court left the door open to the crafting of a Charter-compliant abortion law. And in the immediate aftermath of the decision, the majority of MPs agreed some form of legislation was in order. Since then, it has been nailed shut, in no small part because of Stephen Harper’s decision to commit a future Conservative government to not relitigate the issue.
Its battle against same-sex marriage was lost first in Parliament and eventually within the Conservative Party of Canada . The party renounced the exclusively heterosexual definition of marriage shortly after its 2015 election defeat. Paul Martin’s government had to be dragged to the altar of same-sex marriage, and only after having exhausted all legal avenues — including an extended Supreme Court reference — to delay the inevitable.
In the current campaign to find a successor for Erin O’Toole, the three main contenders are all on the record as supporters of abortion rights.
