Abubakar Malami, attorney-general of he federation , says the federal government will effect a judgment which ordered the removal of section 84 of the amended Electoral Act, 2022.He, however, asked the national assembly to delete section 84 of the act, which reads: “No political appointee at any level shall be a voting delegate or be voted for at the convention or congress of any political party for the purpose of the nomination of candidates for any election.

Subsequently, the AGF said the federal government will consider all other options available before taking a position on the matter. Delivering a ruling on Friday in a suit marked FHC/UM/CS/26/2022, Evelyn Anyadike, the presiding judge, held that the section was unconstitutional.

The FG should not do this. The judiciary and the executive do not have democratic authority to make or delete laws.

I believe that only the NASS has powers to make& amend laws. Malami who is pursuing selfish interest is obviously behind this. Neither judiciary nor executive can amend laws. The section doesn't violate any rights of appointees as option of resignation to fully participate exists

I'm sure an appeal will forestall the process. I'm wondering how Buhari read this document for years and did not see this section.

Executive should know that it is not the duty of court to amend the laws made by the prelimintaria if they don't know, the duty of the court is to implement the law while prelimintaria make law. So executive should beware of their actions.

FedMinOfJustice The jungle judgement by a sold out political judge is a scam. Hence, for that amended section to be scrap it has to follow the principle of separation of power. By the way, the judiciary are to interpret the law but not to play politics with our Constitution.
