The second impeachment trial of former President Donald Trump is now underway with the Republicans forwarding key arguments regarding the legitimacy of the proceedings.

The second impeachment trial of former President Donald Trump is now underway with the Republicans forwarding key argument regarding the legitimacy of the proceedings. Trump advocates have argued it is unconstitutional to impeach a President after he has left office for something he did in office, a claim which has been condemned by the Democrats who believe this would create what they have labelled a "January exception".

The Senate trial will open with four hours of debate followed by 16 hours for both parties to present arguments and will conclude with four hours for questions and four hours of closing arguments. The proceedings will finish with a final vote to decide whether the President should be convicted or acquitted of the charges laid against him. For Donald Trump to be convicted, 17 Republicans would need to cross the floor which is currently deemed very unlikely.

‘Impossible’ to convict Trump due to ‘narrow indictment’ forwarded by Democrats | Sky News AustraliaFormer White House Chief of Staff Mick Mulvaney says the acquittal of former President Donald Trump is a “foregone conclusion” due to the nature of the “narrow indictment” of incitement to riot put forward by House Democrats.\n\n“I was expecting a much more serious trial,' he said. \n\nMr Mulvaney said the role of the House of Representatives during an impeachment trial is to “judge whether or not a trial is justified” whereas the role of the Senate is to act as a juror when the evidence is presented.\n\n“It looks like that is not going to happen. It looks as if the prosecution will focus mostly on politics and not on what actually happened that day,” he told Sky News.\n\n“The dye for that was set when the House of Representatives only sought to charge Donald Trump with incitement to riot which means that only things up to the riot will be relevant.\n\n“There’ll be a vote late this week or later this weekend and Donald Trump will be acquitted a second time.”\n\nMr Mulvaney said a conviction was “not possible” under the charge put forward by the Democrats which will limit the evidence to things said during and in anticipation of the rally before the riots.\n\n“I thought the president’s conduct during the riots was far less than you’d expect of the President of the United States”.\n\n“But that doesn’t go to the heart of this actual impeachment.”\n\n “I still don’t think the president did enough in a timely fashion. I’m not ashamed of saying that but it’s not going to be relevant to the outcome of this impeachment trial.” \n
