Sarawak-based High Court judicial commissioner Leonard David Shim allowed for the adjournment after hearing submissions from both parties on Monday after counsel for the assemblymen, Tengku Fuad Tengku Ahmad, applied for more time to reply to the submissions.
State Attorney General Brenndon Keith Soh told reporters outside the courtroom that the applicants had wanted to put further submissions in so the court would deliberate on it on Wednesday and have a ruling by Friday. Soh said this is because Malaysia subscribes to the separation of powers where there are three equal branches – the judiciary, executive and legislative – and they should not encroach into one another’s respective domains.
As for whether the application for leave for judicial review is granted or not, Soh said the matter rests there if leave is not granted.
