Sri Ram, a former federal court judge, is leading the prosecution in Najib’s 1Malaysia Development Bhd -linked cases and Shafee’s money laundering case relating to two charges involving RM9.5mil.
He said the precise parameter to commence judicial review was granted by the Court of Appeal and was confined to only three issues. "It was also not the pleaded case of the applicants that Thomas was aware of the contents of those WhatsApp messages in making his decision to appoint Sri Ram as a senior deputy public prosecutor," he said.
Shafee submitted that Thomas’ appointment as the AG was a political appointment, which resulted in him resigning while Apandi had stayed on until he was terminated, and this was the proper conduct of a civil servant. In December 2018, Najib and Shafee had separately filed for the judicial review to challenge the Attorney General's decision to appoint Sri Ram as a deputy public prosecutor under Section 376 of the Criminal Procedure Code.
