NEW: A sharply divided U.S. Supreme Court denied a rural Nevada church’s request to strike down as unconstitutional a 50-person cap on worship services as part of the state’s ongoing response to the coronavirus.

Chief Justice John Roberts sided with the liberal majority in denying the request without explanation. Kavanaugh also wrote his own dissent, as did Justice Neil Gorsuch, who said today’s world “with a pandemic upon us, poses unusual challenges.” "When the government treats churches worse than casinos, gyms, and indoor amusement parks in its COVID-19 response, it clearly violates the Constitution,” he said.Calvary Chapel Dayton Valley appealed to the 9th U.S. Circuit Court of Appeals last month after a U.S. judge in Nevada upheld the state’s policy that allows casinos and other businesses to operate at 50% of normal capacity.

“The governor allows hundreds to thousands to assemble in pursuit of financial fortunes but only 50 to gather in pursuit of spiritual ones. That is unconstitutional,” its lawyers wrote in their most recent filing to the high court last week. “Temporarily narrowing restrictions on the size of mass gatherings, including for religious services, protects the health and well-being of Nevada citizens during a global pandemic,” they wrote.

Church is not the building, it is the people. They can get together on zoom or FaceTime.

If it was a sharply divided court, Roberts would have sided with the conservatives. It seems the Supreme Court has been making a few rulings recently that aren't nearly as divided as Congress.

Sadly, a church fighting this instead of working to control the spread and doing their part like other churches are. Should tell you something about the church leaders. You know those false Christians

I agree with that cap. That's what needs to happen and people need to be forced to move out of the big cities but their first couple months of rent as well as transportation if they need it until they find a new job or way to work should be paid for. People need to spread out

There's no cap on protests...

The ristrictions/rules are so random. I was just in a clothing store where you could shop and buy, but not try on the clothes before purchase. How does that make sense? In a dressing room you are 6 feet from anyone else. They cited 'CDC' rules. Scrutinize the CDC for stupidity.

Chief Roberts is really causing damage to the credibility of the Supreme Court.

If God is everywhere then why do churches feel people must attend to speak to God ?

They should have as many as they want and say it’s a “protest”. People need to learn how to work around these state things.
