Legal experts have warned the Morrison government's push to streamline major development assessments leaves it vulnerable to legal challenges under its own federal environmental protection laws.the approval regime for major developments and promised to negotiate a "single touch" assessment system with state governments through the national cabinet.

A ruling in the Federal Court last month found in favour of a community environmental group which argued the state logging agency breached the federal legislation by failing to protect the endangered Leadbeater's possum when it logged 66 sites designated for logging in Victoria's Central Highlands.

"Now it becomes a factual question of whether a logging operation complies with the EPBC Act, or not." But the Auditor-General said Victoria had “not met its commitments” to protect the critically endangered habitat listed under federal law, which was “vital to ensure their future existence”.
