A Federal Court judge has ordered Home Affairs Minister Peter Dutton to make a decision on a detained Iranian man's longstanding application for a protection visa or face the possibility of being found in contempt of court.published on Wednesday, Justice Geoffrey Flight said a decision in the man's case must be made by 26 June and said the Minister had acted"contrary to law" by failing to comply with an earlier ruling.
Shortly after, however, lawyers acting on behalf of the applicant were informed that the government intended to appeal the judgement. "The stance of 'the Minister', expressed as it is, makes a mockery of any concept of the Minister acting as a model litigant," the judgement read.

The judge sounds like a spanker. He did not order the minister to make a decision so the failure to make a decision is not contrary to law. He has now ordered the minister to make a decision and is carrying on like the minister has refused when he hasn't previously been directed.
