Peter Dutton threatened with contempt of court over visa delay

A Federal Court judge has said there is no self-evident reason why a government minister could not be fined or jailed if found guilty of contempt of court, in a strongly worded rebuke to Home Affairs Minister Peter Dutton.

But a decision was not made, and lawyers acting for Mr Dutton and his colleague, Immigration Minister David Coleman, wrote to the man's lawyers by email and said "the minister" believed Justice Flick was "in error" and they would lodge an appeal.Justice Flick said on Wednesday "regrettably, by that email 'the Minister' has intentionally opted not to comply with the law".Migration Act does so in accordance with law," he said.

Justice Flick said "parties to a proceeding who fail to comply with orders made are possibly guilty of a contempt of court and thereby exposed to sanctions ranging from the imposition of a fine through to imprisonment". He said it was, "to say the least, regrettable that those responsible for administering the Migration Act in accordance with law have deliberately decided to administer that legislation in a manner contrary to law".
