A human rights lawyer, Mr Femi Falana , and the Presidential Advisory Committee Against Corruption have faulted Friday’s judgment which nullified the trial and conviction of a former Governor of Abia

State, Orji Kalu, and others for N7.1bn fraud.

He said, “Concerned legislators are urged to go back to the drawing board and ensure that a provision similar to Section 396 of the ACJA 2015 is entrenched in the 1999 Constitution without any delay.” Reacting to the judgment, Falana noted that lawyers who commended the Supreme Court verdict “failed to advert their minds to similar provisions in other statutes which are regularly applied by the Supreme Court and the Court of Appeal.

“Having regards to the authoritative pronouncement of the Supreme Court on the invalidity of Section 396 of the ACJA, it has become constitutionally anomalous for justices of the Supreme Court to perform the functions of a high court in the course of hearing and determining civil and criminal appeals.”

Sagay panel supercede supreme Court order? NGRPresident PoliceNG HouseNGR Abiastategov

The Supreme Court is no longer supreme when every of its Judgements are now questioned. Its either the Justices are bent or they are not of the caliber expected. Surely one of these must be the case.

Some people hail this verdict bcos it concerns their own, I wonder what they would've said if the S'Court verdict had been in favour of two fmr govs from the north earlier convicted and it doesn't affect Kalu. By now they would've been criticizing PMB

Birds of the same feather

I really don't care about the judgement but public criticisms of Supreme Court's verdicts by senior lawyers have become worrisome. They serve to erode faith in the judiciary.

Sagay panel's opinion is very irrelevant. Is the panel now constituting itself into a back door Supreme Court? Sagay failed in his attempt to become VC of University of Benin.
