A senior member of the House Committee on Legislative Franchises on Monday lauded the Supreme Court’s issuance of a temporary restraining order stopping a lower court from striking down as unconstitutional a legislative franchise the House of Representatives has issued.

PBA Partylist Rep. Jericho Nograles said they had expected the SC to stop the implementation of the decision of the Mandaluyong City Regional Trial Court to invalidate the legislative franchise granted by Congress to the More Power and Electric Corporation based in Iloilo City.

Two recently-approved legislative franchises endorsed by the House panel also contained the eminent domain provisions. These are the Lanao del Norte Electric Cooperative and the Bicol Light and and Power Corporation. PECO is the complainant in a Mandaluyong Regional Trial Court dispute wherein the Iloilo-based electric firm won a court ruling that assailed Republic Act 11212 for containing an allegedly unconstitutional provision that extended the authority of eminent domain to More Power and Electric Corp.
