Former White House counsel Don McGahn must testify in impeachment probe against President Donald Trump, judge rules by JanNWolfe

WASHINGTON - Former White House counsel Don McGahn must testify in the impeachment inquiry against President Donald Trump, a federal judge ruled on Monday, rejecting the administration’s assertion of immunity for officials by declaring that “no one is above the law.”

“Executive branch officials are not absolutely immune from compulsory congressional process - no matter how many times the executive branch has asserted as much over the years - even if the president expressly directs such officials’ noncompliance,” Jackson wrote, adding that “this result is unavoidable as a matter of basic constitutional law.”

The subpoena to McGahn was issued months before the House opened an impeachment inquiry in September into Trump’s actions concerning Ukraine. The committee sued McGahn in August to try to enforce the subpoena. Mueller’s report, released in redacted form in April, revealed about 10 instances in which Trump took actions aimed at impeding the investigation. Mueller did not exonerate Trump of obstruction of justice, though Attorney General William Barr, a Trump appointee, afterward decided that the president had not committed obstruction.

McGahn’s relationship with Trump was strained by events of the Mueller investigation. Trump replaced him with Pat Cipollone, who still holds the job.

JanNWolfe Was he a fact witness of the telephone call ?

JanNWolfe Good. The whole point of forming the republic, the house, the senate, the supreme court and the presidency was to do away with kings and their ilk.

JanNWolfe A lower court judge’s ruling is a “nice to have” ornament for the Dems, but a clash of this magnitude between Article 1 and Article 2 won’t be finalized at that level.

JanNWolfe Purely this is a clear democratic legal principle, we salute the court for this reasonable application of Democratic constitutional requirement. Law vs personality. Law must win and has demonstrated that no 'one is above the law' : Don McGahn must testify.

JanNWolfe The Judgement/Order will be overturned by a Higher Court. A Higher Court that is more interested in the The Law than in a prejudiced and biased, partisan RESIST show, exhibited at the Lower Court.

JanNWolfe

JanNWolfe He must answer the subpoena, not that he must testify iirc

JanNWolfe They'll be onto the cleaners and maintenance staff soon. Literally no evidence.

JanNWolfe Trump is screwed

JanNWolfe Makes you wonder, if all these people can exonerate him, why aren’t they being allowed to shout out their truths? 🤔🤔

JanNWolfe And the morons in media will claim this is “BOMBSHELL” testimony. Seeing a trend yet?

JanNWolfe 🙄

JanNWolfe Oh that sucks for you and Trump dude

JanNWolfe And the others?
