In what is believed to be the first judgment of its kind under the 2011 Property Services Act, the High Court has banned a man from seeking a licence to provide property services in Ireland.

The ban is believed to be the first of its kind made under the 2011 Property Services Act and was imposed after findings of improper conduct by the man, including misappropriating money paid by clients.

He must pay €48,000 into the Property Services Regulatory Authority's compensation fund and €50,000 as a financial penalty for the acts of improper conduct. The PRSA appointed inspectors to investigate Mr Breathnach after six separate complaints were made against him in February and March 2017. The inspectors reported there had been improper conduct and Mr Breathnach was no longer a fit and proper person to provide property services.
