The Court of Apeal has upheld a High Court order giving Wicklow County Council three years to clean up what was described as a huge and "appalling" illegal dump with a "Kafkaesque" history.
Ms Justice Caroline Costello said the council itself had dumped vast amounts of waste over two decades on the site at Whitestown near Baltinglass. She said it was aware or should have been from the mid 1990s of the "shocking'" breach of the Waste Management Act.A company called Brownfield Restoration Ireland Limited bought the site in 2003 from the original owners and wants to run a lawful landfill there.Giving the Appeal Court's judgment, Ms Justice Costello said the steps set out by the High Court all appeared necessary for the huge illegal dump to be remediated.
However the Appeal Court ruled the High Court erred in principle in relation to some costs orders made by him.
