Prime minister condemned over failure to provide statement as judges told his government has 'shown itself unworthy of our trust'

He said the government had made available an internal No10 memo and a set of cabinet minutes that showed Mr Johnson had not been trying to “stymie” parliament when he asked the Queen to order the prorogation. Such claims were “untenable” and “unsustainable”, he said., one of the 11 eleven judges hearing the case, said it was not enough to have documents “floating around” without a signed affidavit.
