A landmark case will decide if Boris Johnson was entitled to prorogue Parliament for five weeks in the run-up to Brexit.

He argued the matter is non-justiciable, meaning it is not something courts should interfere with.Sir James argued that the length of time of the prorogation was reasonable, telling the court they ‘recognised the central planning assumption to get to the Queen’s Speech was incredibly tight anyway and a period of five weeks was the minimum that would be required to get there.’

The court will have to reconcile contradictory judgements on the legality of progrogation from courts in England and Scotland.A protester in support of Boris Johnson is directed as to where he can stand outside The Supreme Court ahead of a hearing on the legality of proroguing Parliament The High Court in London dismissed the case brought by businesswoman and campaigner Gina Miller, finding that the length of the prorogation was ‘purely political’.

But the Inner House of the Court of Session in Edinburgh ruled that Mr Johnson’s decision was unlawful because ‘it was motivated by the improper purpose of stymying Parliament’. On the first day of the hearing yesterday, a barrister for Mrs Miller, Lord Pannick QC, argued that Mr Johnson’sand that his decision was an ‘unlawful abuse of power’.

Lord Pannick QC said: ‘The exceptional length of the prorogation in this case is strong evidence that the prime minister’s motive was to silence Parliament for that period because he sees Parliament as an obstacle to the furtherance of his political aims.’Lord Pannick added that it was a ‘remarkable feature’ of the proceedings that Mr Johnson has not provided a statement explaining why he advised the Queen to suspend Parliament for the ‘exceptionally long period’.
