All of the 15 justices voted to dismiss the petition filed by Felicitas D. Nacino, Helen E. Ramacula, and the Volunteers Against Crime and Corruption, Inc.“WHEREFORE, the petition is dismissed. The Ombudsman’s Consolidated Resolution dated June 13, 2017 and Consolidated Order dated September 5, 2017 issued in OMB-C-C16-0435 and OMB-C-C-16-448 are AFFIRMED insofar as they found no probable cause to charge private respondents Benigno Simeon C. Aquino III, Alan L.M. Purisima, and Getulio P.
The dismissal was granted on the motion filed by Ombudsman Samuel R. Martires who declared during the hearing that “No President of the Republic of the Philippines must be accused of usurpation of power while in office. Anyone who claims otherwise should go back to college, I am sorry to say that.” In its ruling, the Sandiganbayan said, “Considering that the records of the present cases are bereft of any evidence that would merit further proceedings as against accused Aquino for the charges for violation of Section 3 of R.A. 3019 and usurpation of official functions under Article 177 of the Revised Penal Code, and applying the aforementioned jurisprudential pronouncements, the Court finds that the dismissal of the said cases is indeed warranted.
