The U. S. Court of Appeals for the Ninth Circuit handed a legal victory to minor league baseball players seeking wages that would exceed the minimum by ruling that the players may proceed as a class action lawsuit.

that was part of the $1.3 trillion omnibus bill President Trump signed into law in 2018. That altered the Fair Labor Standards Act of 1938 to add the following:

[A]ny employee employed to play baseball who is compensated pursuant to a contract that provides for a weekly salary for services performed during the league’s championship season at a rate that is not less than a weekly salary equal to the minimum wage under section 6 for a workweek of 40 hours, irrespective of the number of hours the employee devotes to baseball related activities.

But the case the players have brought forth seek to argue the case around state laws. The appeals ruling on Friday overturned part of the prior district court ruling that “certified a California class under Federal Rule of Civil Procedure but denied certification for Arizona and Florida” “It’s a great result for minor league players everywhere,” said Robert King, the Korein Tillery, LLC, partner who argued the case before the Ninth Circuit Court of Appeals on behalf of the plaintiffs. “It was a determined effort by our team at Korein Tillery and our co-counsel at Pearson, Simon & Warshaw. We look forward to prosecuting the case to trial.”
