A prominent Sydney lawyer has had a drug driving charge dismissed after a magistrate found a saliva test at a police station was possibly contaminated because officers did not follow proper procedure.

On Wednesday, the charge of driving with an illicit drug present was dismissed at Downing Centre Local Court, after magistrate Ian Rodgers found police did not adhere to proper procedures in the police station test, which was recorded on video. Giving evidence, both officers denied touching the foam part of the machine. Magistrate Rodgers said this was "impossible to accept", given it was clearly depicted on the footage, and said part of the officers' evidence was "unreliable".
