An Bord Pleanala conceded a court case against the plans but now developers have sought a remittal

A rural community that won its court fight against a proposed biogas plant on the outskirts of their picturesque town is gearing up to get back in the ring with developers again. It was thought the six-year Gort Biogas saga had come to an end when An Bord Pleanala conceded a High Court case against their 2022 approval of the plant.

Gort Biogas Group CLG and the Burren Lowlands CLG took their joint judicial review against ABP’s green light for the application in August 2023 over safety and environmental concerns and claimed legal victory. Yet despite such a potential risk, the environmental impact assessment Sustainable Bioenergy Limited commissioned for their larger plant outside Gort concluded the facility would be exempt from the Control of Major Accident Hazards Regulations.

They added: “Remittal, if granted, will effectively bring us back to where we were in February 2020.... then a new inspector will be assigned to the case, a new report will be issued and another decision by ABP.
