Is it possible to rein in out of control administrative government agencies? The Supreme Court says Yes! Let’s look at the record:
In 1984, the High Court handed down a decision that set forth a test that required federal courts to defer to administrative government agencies concerning the interpretation of specific laws and statutes. This ruling gave rise to the “Chevron Deference,” and as we saw, during the COVID pandemic, it has led to widespread government overreach. However, that changed with the decision of Loper Bright Enterprises v. Raimondo.
The Court concluded: “The Administrative Procedures Act requires courts to exercise their independent judgment in deciding whether an agency has acted within its statutory authority, and courts may not defer to an agency interpretation of the law simply because a statute is ambiguous; Chevron is overruled.”
