The order, according to the Palace, could bring down the price of rice to P6 to P7. However, certain economists had said the impact of the lower tariffs on prices in the local market will not be felt right away. The groups named Marcos Jr., Executive Secretary Lucas Bersamin, National Economic and Development Authority Secretary Arsenio Balisacan and Tariff Commission chairperson Marilou Mendoza as respondents.

The petitioners noted that prior to issuance of EO No. 62, tariffs for corn imports were already lowered to 5 percent; pork, to 15 percent;; and 35 percent tariffs for rice imports under EO No. 10 to 15 percent. “Despite the clear procedure that ensures the exercise of the petitioners of their constitutional right to due process, the issuance of EO 62 was issued in clear violation of the due process. This is tantamount to undue delegation of the delegated rule-making power of the President,” the petition read.

“While addressing inflation is imperative, it should not come at the expense of our local farmers and producers, our food supply’s long-term stability, and the Philippine economy’s long-term stability. The violation of the Flexible Clause in implementing Executive Order No. 62 renders it unconstitutional and invalid,” they added.
