A bill at North restaurant includes a “3% Employee Benefits Surcharge” in Los Gatos, Calif., on Wednesday, Sept. 4, 2019. Restaurant surcharges will remain legal in California, so long as businesses state those fees “clearly and conspicuously” on menus.

Without the industry carve-out, an emergency measure introduced by Sen. Bill Dodd in early June, restaurants, bars and other food service businesses would have been subject to the SB 478 prohibition starting July 1 on so-called “hidden fees.” Restaurateur Helen Nguyen, who owns Pho Ha Noi restaurants in San Jose, Palo Alto, Fremont and Milpitas, was pleased to hear of Saturday’s resolution of the issue.
