In a new court filing, the attorney for a motorist in Centre County alleges his client was the victim of excessive force by an "unhinged, angry and violent member of law enforcement" during a controversial arrest captured on a State Police dashcam video last year.
Dereck Raimey was arrested in a rural area of Centre County in December following a high-speed chase on Interstate 80, where State Police say he initially failed to stop for following a truck too closely. State Police defended their actions, admitting to using "compliance strikes," which included punches, during the arrest.
Raimey's attorney, Patrick Klena, filed a pre-trial motion questioning the validity of the traffic stop and subsequent criminal charges. Klena argues that Raimey did not resist arrest but was instead dealing with conflicting police orders and was subjected to nine punches after being pulled from his vehicle.
Klena further asserts that the police behavior seen on the video should not be condoned. He claims the violent police action affected Raimey's ability to consent to a blood test, which allegedly showed drugs in his system. The case is ongoing, with further developments expected as the court considers the pre-trial motions.
