Sa apat na pahinang resolusyon ng second division ng CA, ibinasura nito ang petition for certiorari ng kampo ni Bantag. Kaugnay ito sa pasya ng Las Piñas City Regional Trial Court Branch 254 noong November 2023 na nagbasura din sa motion to quash information at warrant of arrest, pati na ang pagbasura sa kaniyang motion for reconsideration.
Ipinaliwanag ng CA na batay sa desisyon ng Supreme Court na, “only the may bring or defend actions on behalf of the Republic of the Philippines, or represent the People or State before the SC and the CA.” Nakasaad din na batay sa manual for prosecutors, lahat ng kahilingan sa paghahain para sa petition for certiorari ay dapat ipadaan sa Office of the Prosecutor General"for evaluation and approval prior to the endorsement to the OSG."
“The said procedure along with the non-conformity of the OSG on the filing of instant petition for certiorari calls for the outright dismissal of the petition,” ayon sa CA.Samantala, tinawag ni Roy Mabasa, kapatid ng pinaslang na si Percy Lapid, na “merely a delaying tactic” ang naturang petisyon ng kampo ni Bantag.
“We learned that the CA has finally dismissed Gerald Bantag's motion to nullify the case filed by the DOJ against him in the Las Piñas Regional Trial Court. In short, the motion was merely a delaying tactic,” saad ni Mabasa sa post sa X, dating Twitter.
