U.S. Supreme Court Justice Neil Gorsuch said that the court gave prosecutors a 'powerful new tool' in a dissenting opinion issued on Thursday.The U.S. Supreme Court issued a 6-3 opinion in the Diaz v. United States case, in favor of affirming a conviction of Delilah Guadalupe Diaz, who was arrested and sentenced to seven years in prison after police found over 54 pounds of methamphetamine hidden in her car.
Prosecutors can now put an expert on the stand—someone who apparently has the convenient ability to read minds—and let him hold forth on what 'most' people like the defendant think when they commit a legally proscribed act,' Gorsuch wrote.'Persuaded that today's decision is mistaken, but hopeful that it will ultimately prove immaterial in practice, I respectfully dissent,' Gorsuch added.
