Supreme Court Rules Against Migrants in Dispute Over Deportation Hearing Notices

FILE — The U.S.-Mexico border in El Paso, Texas, on Tuesday, May 9, 2023. A majority of the justices found that the government had fulfilled its duty to tell immigrants about their court dates, even when the information was incomplete. .WASHINGTON — The Supreme Court sided with the federal government Friday in a dispute over what information immigration officials must provide migrants about their deportation hearings.

Notice of such hearings “has been a crucial aspect of federal immigration policy since at least the early 1950s,” added Jackson, who was joined by the court’s other two liberal justices and Justice Neil Gorsuch. Although the numbers have dropped in recent months, the issue has become a growing political liability for President Joe Biden. This month, he issued an executive order to essentially block asylum at the southern border, a major shift in how the country has handled requests by people seeking protection in the United States.

The U.S. Court of Appeals for the 5th Circuit, one of the country’s most conservative appeals courts, heard one of the cases and sided with the government. Judges from the U.S. Court of Appeals for the 9th Circuit, which has typically been one of the most liberal appeals courts, sided with the immigrants in the other two cases.

In September 2018, he asked to reopen his case, arguing that he had never received the details of his hearing and that his children would face exceptional hardship if he were deported.
