The Supreme Court ruled unanimously that the U.S. Trademark Office's rejection of the trademark application was not unconstitutional.

A labor lawyer’s brazen attempt to trademark the innuendo “Trump Too Small” was rejected by the Supreme Court on Thursday, who argued that the federal trademark office did not violate the man’s First Amendment when it rejected his trademark application.“Our courts have long recognized that trademarks containing names may be restricted.

When the U.S. Court of Appeals for the Federal Circuit reviewed the rejection, it unanimously decided that the Lanham Act was unconstitutional, and argued that it did not trump an individual’s ability to criticize a government official or public figure.
