The judge overseeing the Florida classified-document indictment once again showed she’s in no hurry to move that case to a trial. And the D.C. trial? Well, that one’s still stuck in Supreme Court-land.

And in New York, the probation office will hold a virtual interview Monday with Trump, which is the next step in his presentencing process after his hush-money conviction. The former president will participate in the meeting from Palm Beach, Fla., according to a person familiar with the arrangements who spoke on the condition of anonymity to discuss a proceeding that is not public.

A hearing on June 21 and another on June 24 will focus on Trump’s widely disputed argument that special counsel Jack Smith was not lawfully appointed by Attorney General Merrick Garland to oversee the case. This theory has been pushed within some conservative circles, and Cannon said she would allow outside parties — meaning people other than the prosecutors and Trump’s attorneys — to participate in the hearing.

Trump has said attorney-client privilege should apply to these recordings, which include important potential evidence about Trump’s alleged efforts to avoid returning highly classified material to the government after he left office. Prosecutors argue the audio notes arebecause of the crime-fraud exception, which says communications that may have been part of committing a crime may not be shielded.
