Former President Donald Trump was found guilty on all 34 counts in his New York hush money trial last week, making him the first former U.S. president to be a convicted felon.of the U.S. Constitution gives the president pardoning power, except in cases involving impeachment. This means that the president can pardon anyone convicted of a federal crime in a U.S. District Court, the Superior Court of D.C. or a military court martial.
The power does not, however, apply to state crimes. Therefore, Trump’s conviction in New York would not be eligible for a pardon. He could only receive a pardon if New York Gov. Trump does have two outstanding federal cases – one in Washington D.C and one in South Florida – which some experts argue would be eligible. However, a president issuing a self-pardon is unprecedented, so experts disagree on whether it is legal.but that would apply to each one of the 34 counts. Trump could, however, receive probation of conditional discharge instead., it is unlikely that Trump will serve jail time. He does, however, think Trump could possibly serve a home detention sentence.
If Trump does go to prison, even Constitutional experts don’t know what would happen if he were elected. It is almost certain, though, that the courts would need to get involved.
