) - Legal experts don’t believe former President Donald Trump will end up behind bars based on a couple factors, including Trump’s lack of a criminal record. Trump could face up to four years in prison after being convicted Thursday on all 34 counts of falsifying business records, but the likelihood of him going to prison for this type conviction is low according to legal experts WBRC spoke to.
This is a class E felony in New York, which is the lowest tier of felony charges in the state. Legal analyst and Birmingham attorney Roger Appell says Trump could receive probation and fines and that any sentence is expected to run concurrently and not consecutively. “This isn’t a jailable type of offense. It basically has been a misdemeanor where the statute of limitations has already run that was elevated to a felony because of other allegations of other crimes. This is not the kind of case that a person would go to jail for,” Appell said.
Trump will be sentenced July 11. He’s expected to appeal the case which could take months with the presidential election right around the corner.
